Hurley — A 36-year-old former Montreal, Wis., resident was sentenced in Iron County Court Wednesday morning for failure to update information as a sex offender and being a party to the crime of identity theft.
David Trovillion was sentenced by Iron County Judge Patrick Madden to one year in jail for being a party to identity theft, concurrent with an Ashland County sentence Trovillion is serving at the Waupun prison. He was also sentenced Wednesday to a year of incarceration and 12 months of extended supervision for failure to update information as a sex offender, with credit to be given for time served.
According to special Iron County prosecutor Fritz Schellgell, on Feb. 29, 2016, Trovillion failed to provide updated information within 10 days about his status as a sex offender, a Class H felony punishable by up to six years in prison and a $10,000 fine, or both.
The identity theft charge complaint indicated that while Trovillion was employed in Mercer, he had a female companion impersonate another woman so he could get a note from a medical clinic saying he had driven the woman to the clinic. The scheme was hatched as an excuse for his missing work because he had used up his sick time.
Iron County Sheriff’s Department Lt. Paul Samardich became aware of the June 2016 scam when the woman who had been issued the medical card reported it had been used without her permission. The victim had been contacted by the clinic in a follow-up phone call and she said she had not visited there.
The accomplice who used the victim’s card and information at the clinic admitted she was not ill. She was later located, but not charged and is now in another state, Samardich said.
Schellgell told the court Wednesday that the matter had been set for a trial, but he reached a plea agreement with defense attorney Joseph Randtke.
Madden found the defendant guilty of the two counts.
Trovillion was also assessed court costs of $268.
